A presente dissertação intitulada "A prova por reconhecimento e a problemática do erro de identificação", visa revelar a importância e ao mesmo tempo as fragilidades existentes neste meio de prova, no sistema jurídico português. Procurando ao longo do presente trabalho, analisar as principais questões que se levantam ao nível da doutrina e jurisprudência portuguesas, pensamos conseguir abordar os problemas práticos inerentes a este procedimento em fase de inquérito, bem como na fase de audiência de julgamento. Pese embora seja discutido o papel da psicologia aplicada aos casos de erro de identificação, acreditamos que esta tem um papel crucial na descoberta da verdade material, quando usada pelo julgador da causa. Especificamente sobre o erro de identificação, aborda-se no âmbito do sistema Norte-Americano, as principais causas do mesmo, bem como as influências a que as testemunhas poderão estar expostas, o que eventualmente, prejudicará a sua decisão de identificação do suspeito. Por fim, descreve-se alguns casos verídicos de erro de identificação na prova por reconhecimento, numa tentativa de demonstrar a importância de uma identificação positiva, por uma testemunha ou vítima, no momento de decidir entre condenar ou absolver. ; This dissertation, entitled “The recognition evidence and the problem of misidentification”, aims to reveal the importance and, at the same time, the existing weaknesses in this mean of evidence on the Portuguese legal system. Looking over this dissertation, and analyzing the main issues that arise at the level of Portuguese doctrine and jurisprudence, we believe that we can also address the practical problems inherent to this procedure, during the investigation phase or on the phase of the trial. Even though the role of psychology applied to cases of misidentification is discussed, we believe that it plays a crucial role in the discovery of the material truth, when used by the judge of the cause. Specifically concerning the misidentification, it is addressed, under the North American system, regarding it is main causes as well as the influences that witnesses might be exposed to, which will eventually affect their decision of identifying the suspect. Finally, we describe some true cases of misidentification occurrences during the recognition phase, in an attempt to demonstrate the importance of a positive identification by a witness or victim, when the judge of the cause needs to decide between conviction or acquittal.
